I am perpetually entertained by the disconnection between what we do and what we say we do in the chiropractic profession. If I polled chiropractors and asked if they were actively engaged in public health work in their practices, I think its safe to say that most would say “No” or “Hell, no!” First we must define public health. Herein lies the rub. In chiropractic, our perception of public health is rather narrow (since in chiropractic college our public health courses may have focused on microbes, water sanitation, pasteurization, and immunization!). Several different but acceptable definitions for “public health” can be found in various literature. But what is the true meaning of “public health,” this ethereal and rather elusive term?
As a group, the 50,000 chiropractic professionals make up the third largest health care provider in the United States, after the medical and dental professions. They are also the largest alternative medicine provider of natural health care. There is very promising research evidence supporting the cost-effectiveness, low risk, and high patient satisfaction of chiropractic health services with respect to spinal pain and related conditions. Despite the demand, advantages, and efficacy of chiropractic health services, the chiropractic profession is not being integrated into the health care system. Doctors of chiropractic are largely ignored, and their progress is impeded by strong economic groups. Thus, the American public is not receiving the full benefit of natural alternatives for health care. The chiropractic profession has struggled with its definition and adaptation to the modern needs and demands of the health care market and the American public. It is urgent that the chiropractic profession reengineer itself. A strategic plan is needed to integrate chiropractic services into the health care market to improve the quantity and quality of natural health services rendered to the American public. Although many of the chiropractic professions leaders have eloquently written and discussed many critical issues, these discussions have not resulted in a strategic plan for the chiropractic profession. Since the profession has been without guidance or direction, it has reacted to health care market forces, instead of anticipating and acting on the health care market.
The Medical Expenditure Panel Survey (MEPS) sponsored by the Agency for Healthcare Research and Quality is generalizable to the United States. None of the 25,096 participants in the 2000 MEPS identified a chiropractor as their usual source of care, defined as a particular doctors office, clinic, health center, or other place that the individual usually goes to if he/she is sick or needs health advice. Chiropractic visits comprised 6 percent of all office-based health care visits and nearly one in four visits to the offices of health professionals other than physicians. Chiropractors accounted for 14 percent of non-physician office-based expenditures, more than one third of which were paid out of pocket by patients. Only 9 percent of visits to chiropractors offices were referred by physicians. According to MEPS, most visits to chiropractors involved patients with musculoskeletal problems (see accompanying figure). This limited pattern of care contrasts with the much broader scope of primary care clinicians. This supports the recent decision by the Department of Veterans Affairs not to designate chiropractors as primary care providers. A cursory reading of the new legislation might be enough to instantly treble employers workplace stress, but a deeper understanding goes some way to restoring mental equilibrium. The Occupational Safety and Health booklet, Healthy work, Managing Stress in the Workplace, tells employers that “there is only a requirement to manage work stressors or the individuals stressed situation where you can be reasonably expected to know about the stress. Even then the obligation is only to do what is reasonably practicable in the circumstances.”

REFINANCED GRANDFATHERED DEBT QUADS AS grandfathered debt if the mortgage proceeds do not exceed the balance of the old mortgage prior to refinancing. Home mortgage interest expense is deductible if certain requirements are met. In general, mortgage interest expense is deductible only if the home is collateral for the debt (secured debt). If the borrower cannot pay the debt, the lender can use the home to satisfy the loan. Interest expense paid on home acquisition debt, home equity debt, and grandfather debt is generally considered deductible. A mortgage taken out after October 13, 1987, to acquire, build, or substantially improve a qualified residence is classified as home acquisition debt. Many of the trucks you see on the roads today are insured on one of three commercial auto insurance contracts: the truckers form, the motor carrier form or the business auto form. The truckers form is used for firms hauling only goods owned by others. The motor carrier form insures firms hauling both their own goods and the goods of others. The business auto form is used to cover firms hauling only goods that they own. The Insurance Services Office, Inc. (ISO), promulgates all three contracts. We will discuss the exclusions under the business auto policy and how to provide coverage for the excluded risks. To do so, we will consider several examples. In a fictitious example, MBF Corp.s (MBF) annual planning conference was going to be held at a mountain lodge. Conference attendees from all over the country would need to fly into a nearby town, rent four-wheel drive vehicles and drive about 20 miles to the lodge. They argue that, if marijuana, cocaine, heroin, and other drugs were legalized, several positive things would probably occur: (1) drug prices would fall; (2) users would obtain their drugs at low, government-regulated prices, and they would no longer be forced to resort to crime in order to support their habits, (3) levels of drug-related crime, and particularly violent crime, would significantly decline, resulting in less crowded courts, jails, and prisons (this would allow law-enforcement personnel to focus their energies on the “real criminals” in society); and the drug production, distribution, and sale would no longer be controlled by organized crime, and thus such criminal syndicates as the Colombian cocaine “cartels,” the Jamaican “posses,” and the various “mafias” around the country and the world would be decapitalized, and the violence associated with drug distribution rivalries would be eliminated. By contrast, the anti-legalization camp argues that violent crime would not necessarily decline in a legalized drug market. In fact, there are three reasons why it might actually increase. First, removing the criminal sanctions against the possession and distribution of illegal drugs would make them more available and attractive and, hence, would create large numbers of new users. Second, an increase in use would lead to a greater number of dysfunctional addicts who could not support themselves, their habits, or their lifestyles through legitimate means. Hence crime would be their only alternative. Third, more users would mean more of the violence associated with the ingestion of drugs. These divergent points of view tend to persist because the relationships between drugs and crime are quite complex and because the possible outcomes of a legalized drug market are based primarily on speculation. However, it is possible, from a careful review of the existing empirical literature on drugs and violence, to make some educated inferences.

The city of Washington may not require real estate salespeople to have business licenses or impose a tax license on them because Missouri law makes a distinction between real estate brokers and real estate salespeople. Tuesdays decision by the Missouri Court of Appeals, Eastern District, affirmed the decision by the Franklin County Circuit Court to dismiss an information and complaint filed against Daniel Barnhart, a licensed real estate salesperson, by the city. The city charged that Barnhart violated Section 605.010 of the Code of the City of Washington for failing to have a business license. But Barnhart argued that he couldnt be required to get a business license because the Missouri Code of State Regulations prohibited him, as a salesperson, from maintaining an office. The circuit court and the appellate court agreed.

Someday, when you try to get the real estate (invariably, depreciated down to a low tax basis and appreciated in value) out of the corporation, you will run into a double tax. Three days after furniture-makers filed a petition seeking the imposition of antidumping duties of Chinese wood bedroom furniture, the CEO of Furniture Brands International, one of Americas largest furniture manufacturers, vowed to fight against it. Joe Dorn, of the Washington, DC, law firm King Spalding, represents the coalition and union. The day of the filing, Dorn said, The petition presents very compelling evidence of the serious injury suffered by the U.S. wood bedroom industry and its workers from a surge of unfairly priced imports from China. The petition states, Dumped imports were equal to 44 percent of the value of domestic production and 23 percent of the value of apparent domestic consumption in 2002. During January to June 2003, it says, dumped imports were equal to 67 percent of domestic production and 30 percent of apparent consumption. It also contends (The) petitioners net sales value decreased by 23 percent from 2000 to 2002, and by another 24 percent from the periods January to June 2002 (and) January to June 2003.
A coalition of furniture manufacturers plans to target imports of Chinese wood bedroom furniture in an antidumping petition to be filed this fall with the Department of Commerce and the U.S. International Trade Commission. The city of Washington may not require real estate salespeople to have business licenses or impose a tax license on them because Missouri law makes a distinction between real estate brokers and real estate salespeople. Tuesdays decision by the Missouri Court of Appeals, Eastern District, affirmed the decision by the Franklin County Circuit Court to dismiss an information and complaint filed against Daniel Barnhart, a licensed real estate salesperson, by the city. The city charged that Barnhart violated Section 605.010 of the Code of the City of Washington for failing to have a business license. But Barnhart argued that he couldnt be required to get a business license because the Missouri Code of State Regulations prohibited him, as a salesperson, from maintaining an office. The circuit court and the appellate court agreed.

The good doctor has taken a leave of absence from his regular position at least once each year to travel to areas of the world where plastic surgeons simply dont exist. Whats more, he pays for most of his travel expenses out of his own pocket. Over the years, he has traveled to Bolivia, India, Kenya, Mexico, Pakistan, Peru, the Philippines, and Vietnam. What compels a doctor who, in the words of a colleague quoted in the Idaho Statesman article, could be making $1 million a year, to spend his time and money treating patients too poor to pay? Many children in such areas born with cleft palates or other disfiguring birth defects, or those disfigured by burns, have resigned themselves to their fate in life. The parents of such unfortunate children have often abandoned hope that their children will ever appear normal. Dr. Williams has also trained many physicians in the countries he visits in his art so that they can continue to treat patients he is unable to reach. As he told the Statesman, When you can teach the local people to do the work, youre not just treating the patient, youre solving the problem.

Martin v. City of Rochester, 642 NW.2d 1 (Minn. 2002). The Minnesota Supreme Court held that a state medical assistance lien statute is preempted by federal law to the extent that it allows the state to put a lien on the settlement derived from a plaintiffs personal injury action. Reversing the intermediate appellate court, the state high court said federal law bars states from imposing a lien on the “property” of a Medicaid recipient because of medical assistance paid. The court noted that the state law at issue in this case gives the state a lien for the cost of care “upon any and all causes of action” that accrue to the medical assistance recipient as a result of the injuries that necessitated the medical care. Minn. Stat. 256B.042, subd. 1. Under Minnesota law, these causes of action or claims are the personal property of the medical assistance recipient. Therefore, the state medical assistance lien provision appears to conflict with the federal anti-lien provision and should be subjected to a preemption analysis.
